Move-Away Case Victory

In December 2012, Attorney Paula Phinney of The Edmunds Law firm won another move-away case on behalf of the non-custodial parent/father after a two-day trial. Custodial parent/mother wanted to relocate to New York with the parties’ 4 children and wanted an award of child support, spousal support and attorney fees. Our client, the non-custodial parent objected to the move-away request. The court took into consideration the quality of schools in San Diego county versus the schools in New York, the custodial parent’s true reasons for the move, the custodial parent’s history of alcohol consumption and lack of efforts to find work, and denied the request to move-away, and also denied the request for spousal support and attorney fees.
