The firm recently won an ex parte request for our client, a father, who simply wanted to spend a week’s holiday with his two children at a ski resort. The parties had been separated for 8 months, during which time the father was deployed, as he is active-duty military. The father only had one week of leave, which he wanted to spend with the children. The mother did not want the father to spend the time with the children and insisted that his time be either supervised or that he return the children by 6 pm during the week. The mother claimed that the father had alcohol problems, when the father had no DUIs nor reprimands from his command. The court granted the father’s request despite vigorous argument from the mother’s attorney, and allowed the father to spend the week with the children at the resort, and cautioned the mother to prepare the children for the trip accordingly.
