If you’re in an unhappy marriage chances are that you might be thinking about what your alternatives are. Divorce is one thing, but you it’s important to know that a legal separation is another option that you have available.
A separation is not the same thing as a divorce. Unlike divorce, a legal separation does not end a marriage. It allows the couple to live apart for a set amount of time. During this time each person might choose to explore other issues and interests to see if that a divorce is the right thing for them.
Also during this time legal issues can be addressed such as a division of assets, child custody, and spousal support.
It’s important to note that each state has different separation laws. So defining a legal separation can be a little tricky. Some states require that you be separated from your wife for a year before a divorce can be finalized. Generally though they still hold the right to make medical or funeral decisions for the other, and each will be the surviving spouse of the other for purposes of inheritance.
