Attorney Alan Edmunds and his staff of military and security clearance law experts recently received a favorable judgment for a client trying to upgrade his discharge status from the U.S. Navy.

The client was discharged from the Navy with the status of “Other Than Honorable” after two instances of non-judicial punishment for unauthorized absence. Subsequently, he was diagnosed with a mental illness that medical experts said could have contributed to the sailor’s unauthorized absences while in the Navy.

An Air Force Service member was discharged from the U.S. Air Force for misconduct in 2014 and received a General Discharge with an unfavorable re-enlistment code of RE-4, and a narrative of Misconduct. The Edmunds Law Firm prepared a petition with exhibits to the Board of Corrections, and the panel voted 4-1 to upgrade the Airman’s unfavorable discharge to Honorable, with a favorable RE code and a favorable narrative of Secretarial Authority. A former active duty service member received an Other Than Honorable Discharge from the U.S. Navy for Misconduct due to Drug Abuse. The Edmunds Law Firm prepared a professional Petition to the Navy Discharge Review Board with exhibits. After the Navy Discharge Review Board reviewed the case presented by Mr. Edmunds and his staff, the board voted that the former service member’s discharge be upgraded to General (Under Honorable Conditions). This upgrade is positively affecting the former service member, and he is now eligible to receive veterans benefits that he did not have before. The Edmunds Law Firm has effectively improved and changed the quality of life this veteran will have for now and forever in his future!


The Edmunds Law Firm retained for a military upgrade and document review only by the upgrade board. Applicant received a bad conduct discharged based on a Special Court martial. Since Applicant’s discharge 10 years ago, Applicant has earned a degree and has been an upstanding citizen. On 8/8/12, the upgrade board granted Applicant’s request for an upgrade of his current discharge, and upgraded the discharge status from Bad Conduct to Under Other Than Honorable Conditions.

Military Discharge Upgrade Granted

The Edmunds Law Firm received notification of a favorable determination regarding an Applicant’s request to upgrade his discharge from the United States Army. The hearing for this matter was held before the Department of the Army – Army Review Boards Agency on Wednesday, February 23, 2011 in Dallas, TX. In this matter, the Applicant received a general under honorable conditions discharge for misconduct, or wrongful use of cocaine and marijuana. The Edmunds Law Firm submitted written argument, military records and provided a narrative reason from the Applicant to prove he is trustworthy, reliable and not a risk to national security. After careful review of all available evidence, the Army Discharge Review Board determined that relief was warranted. The Applicant’s discharge has been upgraded and he is now eligible to re-enlist.


Military Discharge Upgrade Granted

The Edmunds Law Firm received notification of a favorable decision made after submitting a request for discharge upgrade to the Naval Discharge Review Board. Applicant was discharged from the Marine Corps after a Court Martial Hearing involving a violation of the Uniform Code of Military Justice Article 86 – Unauthorized Absence. Applicant was absent for over a year when he was apprehended. The Edmunds Law Firm submitted documentation and exhibits to show that Applicant had mitigated the Government’s concerns and made significant improvements. The Review Board noted that although they agreed with the original sentence awarded, Applicant’s post-service efforts to improve his life granted him clemency and his upgrade was granted.


Military Discharge Upgrade Granted

The Edmunds Law Firm recently successfully resolve a case involving drug use and possession by an active duty Marine. The case occurred in San Diego, California. The charge sheet included allegations of possession of a controlled substance as well as use of a controlled substance.

Attorney Edmunds, an experienced military law attorney, represented the individual. Negotiations were commenced and a successful resolution was reached which included a complete dismissal of the charges and an administrative separation for the client. This client, because of the work of Attorney Edmunds, avoided a federal criminal conviction on his record as well as any time in custody. He received an administrative separation and was released from the Marine Corps.


Military Discharge Upgrade Granted

The Edmunds Law Firm has received a favorable decision from the Department of the Army in a Military Discharge case. The case was decided by the Army Discharge Review Board in favor of the client represented by Mr. Alan Edmunds. This was a case involving an isolated incidence of drug use. Mr. Edmunds produced documents such as drug screens, letters of recommendation and certificates of achievement. The Army Discharge Review Board accepted Attorney Edmunds’ arguments as well as evidence produced by the client and found that the discrediting entry in the client’s service record had been effectively mitigated. The Army Discharge Review Board granted relief to the client in the form of an upgrade of his discharge to fully honorable.


Military Discharge Upgrade Granted

It’s another favorable outcome for the Edmunds Law Firm. The Army Discharge Review Board recommended a discharge upgrade in case number AR20060016203, allowing Attorney Edmunds’ client the opportunity to re-enlist in the National Guard. The client was discharged from the National Guard following positive drug test results. The Army Discharge Review Board found several mitigating factors in Mr. Edmunds’ arguments and the client’s testimony. As a result, the Board voted to recommend a change to the client’s military records in the form of a discharge upgrade to fully honorable allowing the client the opportunity to re-enlist and continue to serve his country.


Military Discharge Upgrade Granted

The Edmunds Law Firm has received another favorable decision, this time from the Department of the Navy. Case number ND07-00466 was upgraded from a General Discharge (Under Honorable Conditions) to an Honorable Discharge. Attorney Alan Edmunds has shown, once again, that experience makes the difference.

The Applicant was discharged from the Navy with a General (under honorable conditions) rating due to “personality disorder.” The Navy Medical Review Board found that the Applicant was not medically ill, but had a long-standing character and behavior disorder rendering him unsuitable for continued military service. The Applicant had wished to remain in the Navy.

Attorney Edmunds appeared in front of the Naval Discharge Review Board to present the Applicant’s case. Exhibits were submitted and Mr. Edmunds was able to prove that there was no evidence in the Applicant’s service record of misconduct, and the Applicant’s evaluation ratings did reflect an acceptable level of performance and conduct.

The Naval Discharge Review Board determined that the characterization of the Applicant’s service as general was not consistent with the standards of naval discipline.
