Civil Law
San Diego Superior Court
December 13, 2015

On December 13, 2011 the Law Firm received a favorable decision due to the outstanding trial advocacy of attorney Steve Smith with the firm. Attorney Smith appeared in a Civil Court for a Civil Restraining Order and at the conclusion of the moving parties evidence made a motion for a Directed Verdict.

A Directed Verdict is a highly unusual motion to make and simply states to the Court that the opposing party did not prove their case and the trial should not proceed. Mr. Smith’s motion was granted and thus our client saved a tremendous amount of time, money and anxiety. The Law Firm did not have to present any witnesses or offer any evidence. The Court concurred with Mr. Smith’s summary that the opposing party did not prove their cause of action and the Court granted a favorable decision for our client.

This is another example of a job well done by our attorney’s who travel nationally defending the interest of our client’s. Whether the case involves a National Security Clearance, Military law, Family law, and Criminal law issues, our staff of professionals is there to protect our clients to the fullest.

Military Discharge Upgrade Granted
Case No.: ND07-00466
November 15, 2014

The Edmunds Law Firm has received another favorable decision, this time from the Department of the Navy. On November 15, 2007 case number ND07-00466 was upgraded from a General Discharge (Under Honorable Conditions) to an Honorable Discharge. Attorney Alan Edmunds has shown, once again, that experience makes the difference.

The Applicant was discharged from the Navy with a General (under honorable conditions) rating due to “personality disorder.” The Navy Medical Review Board found that the Applicant was not medically ill, but had a long-standing character and behavior disorder rendering him unsuitable for continued military service. The Applicant had wished to remain in the Navy.

Attorney Edmunds appeared in front of the Naval Discharge Review Board to present the Applicant’s case. Exhibits were submitted and Mr. Edmunds was able to prove that there was no evidence in the Applicant’s service record of misconduct, and the Applicant’s evaluation ratings did reflect an acceptable level of performance and conduct.

The Naval Discharge Review Board determined that the characterization of the Applicant’s service as general was not consistent with the standards of naval discipline.
