Security Clearance Verdicts and Press Releases

The Law Offices of Edmunds & Claery, LLP has received another favorable decision, this time from the Department of the Navy.  On November 15, 2007 case number ND07-00466  was upgraded from a General Discharge (Under Honorable Conditions) to an Honorable Discharge.  Attorney Alan Edmunds has shown, once again, that experience makes the difference. The Applicant was discharged from the Navy with a General (under honorable conditions) rating due to “personality disorder.”  Attorney Edmunds appeared in front of the Naval Discharge Review Board to present the Applicant’s case and was able to prove that there was no evidence in the Applicant’s service record of misconduct, and the Applicant’s evaluation ratings did reflect an acceptable level of performance and conduct.  The Law Offices of Edmunds & Claery, LLP represents individuals throughout the world with regard to Military matters. Attorney Alan V. Edmunds from the Law Offices of Edmunds & Claery, LLP has had another victory in the Federal Court on a National Security Case.  On October 31, 2007 the Administrative Law Judge found in favor of the Applicant represented by Mr. Edmunds proving that experience makes the difference.  The Department of Defense sought to deny the Applicant’s Security Clearance based on Guideline F (Financial Considerations).  Although the Applicant had filed for bankruptcy twice, Attorney Edmunds was able to prove that he was not a security concern. Another favorable decision has been granted to a National Security Clearance Applicant, represented by Attorney Alan Edmunds of the Law Offices of Edmunds & Claery, LLP.

In case number 03-25260 the Department of Defense intended to revoke the Applicant’s security clearance based on Guideline B (Foreign Influence).  The Government was concerned that the Applicant “may be manipulated or induced to help a foreign person, group, organization or government in a way that is not in U.S. interests or is vulnerable to pressure or coercion by any foreign interests.” Attorney Edmunds submitted numerous character references and performance evaluations to the Department of Defense on behalf of the Applicant. On August 23, 2007 Alan Edmunds of the Law Offices of Edmunds & Claery, LLP, was granted yet another favorable decision by the Administrative Law Judge in a National Security case proving that experience makes the difference. Case number 07-01845 involved a 30 year old applicant who received a Letter of Intent to Deny Security Clearance based on Guideline E (personal conduct), Guideline I (Emotional, Mental and Personality Disorders) and Guideline J (criminal conduct). Attorney Edmunds submitted several items into evidence. Upon evaluation the Judge found that is was clearly consistent with the national interest to grant or continue Applicant’s security clearance.

Attorney Alan V. This particular case involved allegations of wrongful use of a controlled substance. Military Discharge Verdicts and Press Releases

The Law Offices of Edmunds & Claery, LLP has received yet another favorable decision from the Department of the Army in a Military Discharge case. On July 11, 2007 case Number AR20060017195 was decided by the Army Discharge Review Board in favor of the client represented by Mr. Alan Edmunds. This was a case involving an isolated incidence of drug use. Mr. Edmunds produced documents such as drug screens, letters of recommendation and certificates of achievement.  The Army Discharge Review Board accepted Attorney Edmunds’ arguments as well as evidence produced by the client and found that the discrediting entry in the client’s service record had been effectively mitigated.  The Army Discharge Review Board granted relief to the client in the form of an upgrade of his discharge to fully honorable. It’s another favorable outcome for the Law Offices of Edmunds & Claery, LLP.  On July 11, 2007 the Army Discharge Review Board recommended a discharge upgrade in case number AR20060016203, allowing Attorney Edmunds’ client the opportunity to re-enlist in the National Guard. The client was discharged from the National Guard following positive drug test results.    The Army Discharge Review Board found several mitigating factors in Mr. Edmunds’ arguments and the client’s testimony. As a result, the Board voted to recommend a change to the client’s military records in the form of a discharge upgrade to fully honorable allowing the client the opportunity to re-enlist and continue to serve his country. The Applicant was discharged from the Navy with a General (under honorable conditions) rating due to “personality disorder.”  The Navy Medical Review Board found  that the Applicant was not medically ill, but had a long-standing character and behavior disorder rendering him unsuitable for continued military service.  The Applicant had wished to remain in the Navy. 

Attorney Edmunds appeared in front of the Naval Discharge Review Board to present the Applicant’s case.  Exhibits were submitted and Mr. Edmunds was able to prove that there was no evidence in the Applicant’s service record of misconduct, and the Applicant’s evaluation ratings did reflect an acceptable level of performance and conduct. 

The Naval Discharge Review Board determined that the characterization of the Applicant’s service as general was not consistent with the standards of naval discipline.
