Over the last several years, the collaborative approach to divorce has been sought by couples hoping to keep things more amicable and less combative.
The decision to split can be an emotionally charged event as is, but some couples want to prevent the divorce from becoming a bitter, drawn out event by settling issues without court intervention.
By working together with specially trained lawyers, the goal of the collaborative process is to settle divorce related issues, including child support, parenting time, alimony and division of property. Instead of turning the sides against each other, the collaborative process works on negotiating settlements directly and attorneys are on hand for suggestions and to prepare and file necessary paperwork.
The collaborative divorce process usually has a faster and cheaper resolution than a typical divorce. Unlike mediation, which is an alternative conflict resolution process as well, collaborative clients negotiate their settlements directly without a mediator guiding the couple towards a middle ground.
Collaborative divorce attorneys are not focused on how to argue an issue, but are instead focused on how to help families reach a solution so that they can move on. Especially when children are involved, collaborative divorces can be a good choice when spouses need to maintain at least a pleasant natured relationship for the children.
While the collaborative divorce process does not guarantee everyone will be happy in the end, it does give parties the ability to communicate their goals and maintain control over the divorce settlement. Depending on the splitting couple, a collaborative divorce might be a good alternative.
