
A recent poll has found that 49 percent of lawyers who responded have noted an increase in postnuptial agreements over the past five years.
Responding lawyers said that, surprisingly, 58 percent of lawyers drew up postnuptial agreements at the request of both spouses, not at the request of a wife or husband individually.
Why get a Postnuptial Agreement?
Postnuptial agreements are voluntary contracts entered into by couples who are already married. These agreements can settle disputes over a very wide variety of issues that may arise over the course of a marriage before they occur. Among the topics often covered in postnuptials are:
Couples may also wish to secure future earnings with a postnuptial agreement if the income or financial status of one of the partners has increased or will increase dramatically.
Fostering a Healthy Marriage
The overall goal of a postnuptial agreement is to help prevent future disputes between current spouses over material things and remove stress allowing both spouses to concentrate on their relationship.
“Postnuptial agreements, where valid, can be a good tool for addressing and solving problems spouses might be experiencing in their marriage,” said president of the American Academy of Matromonial Lawyers, Gaetano Ferro.
“Having a written document with expectations and obligations clearly set forth reduces the areas of disagreement for spouses and can remove a good amount of stress from everyday married life,” says Ferro.
